Terms of Service
Effective 13 September 2026. These terms are an agreement between you and Can EHR for use of the proudly Canadian, Ontario-based electronic health record at canehr.ca.
Can EHR is built by a group of professionals in counselling, psychotherapy, psychology, couple therapy, and family therapy, together with IT-oriented team members, to provide specific software for mental health service providers in Ontario. See Who we are.
1. The service
Can EHR is practice software: scheduling, client charts, notes, scribing, online sessions, billing in CAD, and related tools for private practice. It is not a hospital information system, not a medical device, and not a substitute for professional judgment. You are responsible for the care you provide.
2. Who may use it
You must be a clinician or authorized staff of a clinic (counsellor, psychotherapist, psychologist, clinical psychologist, couple therapist, social worker, or similar) and able to contract under Ontario law. You must give accurate clinic details on signup. You may not share your login.
3. Accounts and trial
New clinics receive a 30-day trial. After that, Can EHR is $19.95 per month or $199 per year, plus applicable sales tax, billed in CAD through Stripe unless we agree otherwise. Session invoices you issue to clients for counselling, psychotherapy, or couple therapy are your billing, not Can EHR’s subscription. Therapy sessions on the platform are not charged HST by Can EHR; your own tax advice still applies.
4. Your records
You (or your clinic) are the health information custodian for client records you store. You must obtain consent, limit access, and keep records as PHIPA, PIPEDA, and your college require. Can EHR hosts isolated clinic data so other Can EHR customers cannot see your charts. You must not upload information you have no right to store.
5. Online sessions and scribing
Video sessions, dictation, recording, and AI-assisted notes are tools. You must tell clients when a session is recorded or transcribed and follow your professional rules. Transcripts and generated notes can contain errors. You must review and sign clinical notes before relying on them. Join links are confidential.
6. Acceptable use
You will not break the law, probe the service, resell Can EHR without permission, or use it to harm clients. We may suspend an account that puts the service or others at risk.
7. Intellectual property
Can EHR, the maple/Ontario marks, and the software belong to Can EHR. You keep ownership of the content you enter. You grant us a limited licence to host that content solely to operate the service.
8. Availability and liability
We aim for a reliable service but do not promise uninterrupted access. To the extent Ontario law allows, Can EHR is not liable for lost profits, lost records you failed to export, or care outcomes. Our aggregate liability for a claim relating to the service is limited to the Can EHR subscription fees you paid in the three months before the claim. Some consumer rights cannot be limited; those remain.
9. Ending the agreement
You may stop using Can EHR and ask us to close the account. We may end the service or an account with notice, or immediately for serious breach. Export records you need before you leave. After closure we delete or de-identify data as described in the Privacy Policy, subject to legal holds.
10. Law
These terms are governed by the laws of Ontario and the federal laws of Canada that apply in Ontario. Courts in Toronto, Ontario have exclusive jurisdiction, except that we may seek injunctive relief anywhere.
